The NBA legend Tells Court He Felt No Fear of Nascar in Antitrust Trial
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and novelty within the sport emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared financial and corporate details of his racing venture, revealing he put in $40 million of his personal wealth into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”
The Core Dispute: Franchise System and Renewal Demands
At issue is the expiration of a 2016 agreement where Nascar granted each team a franchise. The concept is similar to other professional sports with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with fans and media vying for a view or a picture of the sports legend.
Leading the Legal Charge
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a frantic and emotional six hours where the sanctioning body told teams they had to sign a charter agreement extension. This agreement consists of over a hundred pages detailing pay for chartered teams and a guaranteed entry in Nascar-sponsored races.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. All other teams signed the agreement.
The team owners reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.

But in the end, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Winning.
“Hamlin persuaded me getting a third driver improved our chances to win,” he testified, sharing that he purchased another franchise late in 2024 for $28m amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, submitted in a written letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
